Howler Brothers Yellow Rose Scavenger Hunt

NO PURCHASE IS NECESSARY TO PARTICIPATE OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES 18+ YEARS OF AGE AT THE TIME OF PARTICIPATION. CONTEST IS SET IN AUSTIN, TEXAS. VOID WHERE PROHIBITED BY LAW. BY PARTICIPATING IN THIS CONTEST, YOU CONSENT TO BE BOUND BY THESE OFFICIAL RULES. ONE PRIZE PER PERSON, NO EXCEPTIONS.

THESE OFFICIAL RULES CONTAIN A JURY TRIAL WAIVER AND CLASS ACTION WAIVER, WHICH AFFECT YOUR LEGAL RIGHTS. PLEASE READ SECTION 13 CAREFULLY.

1. Howler Brothers Yellow Rose Scavenger Hunt

This contest (the “Contest”) is administered and sponsored by Heard Design, LLC d/b/a Howler Brothers (“Howler Brothers” or “Sponsor”). The Contest involves 10 yellow roses created and hidden by Sponsor (each, a “Yellow Rose” and collectively, the “Yellow Roses”). By participating in the Contest, you agree to be bound by these Official Rules and the decisions of Sponsor respecting the Contest. Sponsor reserves the right to make changes, corrections, cancellations and/or improvements to the information provided in this Contest and the Official Rules, and to the products and programs described in this promotion at any time without notice.

2. Eligibility

To be eligible to participate, you must be a legal resident of the United States and at least 18 years of age at the time of participating. To claim a prize, participants must (i) find a Yellow Rose and (ii) turn in the Yellow Rose to Sponsor at the Howler Brothers Headquarters located at 1010-A West Lynn St., Austin, TX 78703 (the “Headquarters”) during business hours (Monday - Friday, 9AM–5PM CT). Any person who is an employee, contractor, officer, director, agent, or other representative of Sponsor, or of any of Sponsor’s affiliates or agencies, and members of such person’s immediate family and persons living in the same household with such person, are not eligible to participate in this Contest. Sponsor may, in its sole discretion, disqualify any person if it is determined that awarding a prize to such a winner might reflect negatively on Sponsor.

3. Contest Period

The Contest begins on September 9, 2026 at 10 AM CT and ends on the later of (i) the day all Prizes have been claimed and (ii) October 1, 2026 at 12 PM CT (the “Contest Period”). All Yellow Roses must be found and submitted to Sponsor during the Contest Period. Any Yellow Rose submitted after the Contest Period ends will not be eligible for a Prize.

4. How to Participate

No purchase necessary to participate or win. To participate, participants must search for and find a Yellow Rose and physically present the found Yellow Rose in person at the Headquarters during business hours. Each participant may only claim one Prize. A participant that does not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual who does not follow these Official Rules.

Participating in the Contest has no value and does not entitle a participant to any compensation of any type or kind. 

5. Prize

There will be 10 winners, each of whom will receive one of the prizes (each a “Prize”) below. Each participant may only win one Prize, regardless of the number of Yellow Roses found by such participant.

THE PRIZE INCLUDES THE TICKETS ONLY. All travel related expenses, including, but not limited to, transportation to and from the venue, service charges, food and beverage, and personal expenses are the sole responsibility of the winner.

Sponsor reserves the right, in its sole discretion, to substitute any Prize (or component thereof) with a prize of equal or greater value. This can be for any reason or no reason, including, without limitation, if the advertised Prize becomes unavailable for any reason, including, without limitation, due to event cancellation, venue change, artist scheduling conflicts, or other circumstances beyond Sponsor’s control.

All federal, state and local taxes and any other costs and expenses associated with the acceptance and/or use of a Prize not specifically provided for in these Official Rules are solely the winner’s responsibility. The winner is solely responsible for reporting and paying any and all applicable taxes. The Prize is non-transferable and may not be redeemed for cash. No substitution except at Sponsor’s discretion. Sponsor will award the Prize without any payment or other compensation by the winner.

Prizes as subject to the terms and conditions set forth in these Official Rules, as well as those set forth by the applicable venue, the Festival, and Front Gate Ticketing Solutions as detailed in the Terms of Sale (available at: www.frontgatetickets.com/legal/terms-of-sale).

6. Odds

There are 10 Yellow Roses hidden in the Austin area. Each participant who finds and submits a Yellow Rose in accordance with these Official Rules will be a winner. The odds of winning depend on the participant's ability to locate a Yellow Rose before all 10 Yellow Roses have been found and submitted. 

7. Judging Criteria

To be deemed a winner, the rose submitted must be one of the 10 Yellow Roses. Each Yellow Rose will bear a unique identifier or marking placed by Sponsor. Sponsor shall have sole discretion to determine whether a submitted rose is a Yellow Rose. Any submission that is not a Yellow Rose will be disqualified.

8. Winner Notification

Whether a participant is a winner of the Contest will be determined at the time the participant turns in their Yellow Rose. Winner determinations will be made by Sponsor or its designated representative, whose decision shall be final. Winners will be notified in person at the time their Yellow Rose is submitted and will receive their Prize at that time or by mail to the address provided by the winner. Sponsor may publicly announce the winners on its social media accounts (including by tagging the winner’s Instagram handle, if provided). The winner must sign and return an Affidavit of Eligibility, and Liability and Publicity Release, and W-9 upon Sponsor’s request at the time the Prize is awarded. Noncompliance will result in disqualification and forfeiture of the Prize.

9. Sponsor

The Sponsor of the Contest is Howler Brothers, 1010-A West Lynn St., Austin, TX 78703, United States.

By participating in this Contest, you agree that it is in no way sponsored, endorsed or administered by, or associated with (i) Austin City Limits Musical Festival (“Festival”) or (ii) Meta, Facebook or Instagram (the “Platforms”) and release the Festival and Platforms from any and all liability arising from or related to this Contest. You understand that you are providing your information to the Sponsor and not to Festival or any such Platforms.

10. Right to Cancel or Modify.

Sponsor reserves the right to cancel, suspend, or modify the Contest, in whole or in part, if fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. If the Contest is cancelled or suspended, Sponsor may, in its sole discretion, award prizes to eligible participants who submitted a Yellow Rose prior to such cancellation or suspension and withhold any remaining prizes. Sponsor is not responsible for any injury or damage to participants related to or resulting from participating in the Contest.

11. Release

By accepting a Prize, each winner grants Sponsor (including anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns) the right to use the winner’s name, image and likeness, which includes, without limitation, voice, signature, photograph, biographical information and social media handles (as well as the name, photograph and likeness of their companions) (“Likeness”) for advertising, publicity, promotional and other purposes in any and all media, now or hereafter devised, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law.

Except where otherwise prohibited by law, by participating in this Contest (whether or not awarded a prize), participant grants Sponsor permission to use his/her Likeness for advertising and promotional purposes without compensation.

Sponsor retains all right, title, and interest in and to the Yellow Roses and all materials created by Sponsor in connection with the Contest. By submitting a Yellow Rose, participant acknowledges that the Yellow Rose remains the property of Sponsor and will not be returned.

By submitting a Yellow Rose, participant represents and warrants to Sponsor that he/she is the individual who found the Yellow Rose, is eligible to participate in the Contest in accordance with these Official Rules, and is at least 18 years of age.

12. Limitation of Liability

By participating, you acknowledge that participation in the Contest involves inherent risks, including, but not limited to, risks associated with searching for Yellow Roses in outdoor environments, physical exertion, weather conditions, traffic, pedestrian conditions, and interactions with third parties and property. You voluntarily assume all such risks, both known and unknown, and agree to release and hold harmless Howler Brothers and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors (the “Sponsor Parties”) from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such participant’s participation in the Contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) searching for, locating, handling, or transporting a Yellow Rose; (iii) conditions at any location where a Yellow Rose may be hidden or found; (iv) unauthorized human intervention in any part of the Contest; (v) human error which may occur in the administration of the Contest or the processing of submissions; (vi) weather conditions or physical exertion associated with participation; (vii) interactions with third parties, traffic, or pedestrian conditions; (viii) any claim of trespass arising from a participant’s search for a Yellow Rose; or (ix) any other cause or action related to or arising out of the Contest or any Prize, however caused.

PARTICIPANT FULLY RELEASES THE SPONSOR PARTIES, FESTIVAL AND THE PLATFORMS FROM ANY AND ALL LIABILITY, AND WAIVES ALL SUCH LIABILITY, CAUSED BY OR RESULTING FROM THE USE OR POSSESSION OF ANY PRIZE AWARDED OR CAUSED BY OR RESULTING FROM PARTICIPATION IN THE CONTEST OR ANY RELATED PROMOTION. PARTICIPANT UNDERSTANDS AND AGREES THAT IN NO EVENT WILL THE SPONSOR, FESTIVAL OR THE PLATFORMS BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, STATUTORY OR PUNITIVE DAMAGES ASSOCIATED WITH PARTICIPATION IN THE CONTEST OR USE OF ANY PRIZE. PARTICIPANT FURTHER UNDERSTANDS AND AGREES THAT ANY PRIZE AWARDED IS RECEIVED “AS IS,” WITHOUT ANY WARRANTY OR REPRESENTATION OF ANY KIND FROM SPONSOR, AND THAT ALL SUCH WARRANTIES, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. 

13. Disputes and Governing Law; Jury and Class Action Waiver

THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF TEXAS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, the parties agree that all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action. EACH PARTY AGREES THAT VENUE FOR ANY LEGAL ACTION ARISING OUT OF OR RELATING TO THE CONTEST SHALL BE IN TRAVIS COUNTY, TEXAS, AND SHALL NOT BE SUBJECT TO TRANSFER TO ANOTHER VENUE OR LOCALE, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such legal proceeding. The parties irrevocably and unconditionally waive any objection to venue of any suit, action, or proceeding in such courts and irrevocably waive and agree not to plead or claim in any such court that any such suit, action, or proceeding brought in any such court has been brought in an inconvenient forum. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Contest), and you further waive all rights to have damages multiplied or increased.

EACH PARTY DOES HEREBY WAIVE HIS/HER/ITS RIGHT TO A TRIAL BY JURY, TO PARTICIPATE AS THE MEMBER OF A CLASS IN ANY PURPORTED CLASS ACTION OR OTHER PROCEEDING, OR TO NAME UNNAMED MEMBERS IN ANY PURPORTED CLASS ACTION OR OTHER PROCEEDINGS.

14. Privacy Policy

Information submitted in connection with the Contest is subject to the Privacy Policy stated on the Howler Brothers website. Read the Privacy Policy here: https://howlerbros.com/pages/privacy-policy.

YOU UNDERSTAND AND AGREE THAT THE INFORMATION YOU PROVIDE WILL BE USED FOR MARKETING PURPOSES BY THE SPONSOR. IN ADDITION TO ANY USES OF YOUR INFORMATION MENTIONED IN THESE OFFICIAL RULES, THE PRIVACY POLICY REFERENCED IN THE PARAGRAPH ABOVE WILL GOVERN USE OF YOUR INFORMATION. YOU SHOULD REVIEW THAT PRIVACY POLICY.

15. Winners List

Official Rules and the name of the winners may be obtained by sending a self-addressed, stamped envelope to: Howler Brothers, Attn: Marketing; 1010-A West Lynn St., Austin, TX 78703, United States. Indicate “Howler Brothers Yellow Rose Contest Official Rules Request” or “Howler Brothers Yellow Rose Contest Winner List” on the outside of the envelope, as applicable. Limit one request per envelope. The request must include the name of the Contest. Participants may also submit questions or request the Official Rules by sending an email detailing their request to [INSERT EMAIL ADDRESS]. 16. General Terms

The Contest is subject to all applicable federal, state, and local laws and regulations. The receipt by winner of the Prize offered in this Contest is conditioned upon compliance with all federal and state laws and regulations. VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

The Contest and all related materials, including the Yellow Roses, promotional content, and these Official Rules, are protected by copyright, trademark, and other intellectual property rights. Copying or unauthorized use of any copyrighted material or trademarks without the express written consent of Sponsor is strictly prohibited.

At Sponsor’s sole discretion and option, the dates for the Contest may be extended by no more than 30 days. Sponsor is not responsible for: (i) any lost, stolen, damaged, or destroyed Yellow Rose; (ii) any submission that is not a Yellow Rose; or (iii) any injury, loss, or damage incurred while searching for or transporting a Yellow Rose.

Sponsor reserves the right, in its sole discretion, to suspend, modify, or terminate the Contest, or to disqualify any participant, for any reason, including, but not limited to, any corruption or impairment of the administration, security, fairness, or proper play of the Contest, including, without limitation, any physical altercation, verbal dispute, harassment, intimidation, or any other unsafe or unsportsmanlike conduct between participants arising from or related to the retrieval or possession of a Yellow Rose. If a participant is disqualified while the Contest is ongoing, Sponsor may re-hide the custom yellow rose turned in by such participant. If the Contest is terminated, Sponsor may, in its sole discretion, award any remaining Prize(s) to a charity of Sponsor’s choosing. All decisions of Sponsor in any matter relating to this Contest shall be binding and final.

By participating in the Contest, you acknowledge that Sponsor may use any contact information you provide in connection with your participation or Prize claim to send you marketing communications, if you have opted in to receive such communications. You can opt out of receiving marketing communications at any time by clicking the unsubscribe link in the communication or by contacting Sponsor directly.  

By participating in the Contest, you agree to be fully and unconditionally bound by these Official Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding as they relate to the Contest.

If any provision of these Official Rules is held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
