1. Howler Brothers Los Longhorns de Tejas Surfboard Giveaway
This sweepstakes (the “Sweepstakes”) is administered and sponsored by Heard Design, LLC d/b/a Howler Brothers (“Howler Brothers” or “Sponsor”). By entering the Sweepstakes, you agree to be bound by these Official Rules and the decisions of Sponsor respecting the Sweepstakes. Sponsor reserves the right to make changes, corrections, cancellations and/or improvements to the information provided in this Sweepstakes and the Official Rules, and to the products and programs described in this promotion at any time without notice.
2. Eligibility
To be eligible to enter, you must be a legal resident of the United States and at least 18 years of age at the time of entry. Participants must be physically present at the Howler Brothers Longhorn Luau at Hula Hut on August 13, 2026 to enter. Any person who is an employee, contractor, officer, director, agent or other representative of Sponsor, or of any of Sponsor’s affiliates or agencies, and members of such person’s immediate family and persons living in the same household with such person, are not eligible to participate in this Sweepstakes. Sponsor may, in its sole discretion, disqualify any person if it is determined that awarding a prize to such a winner might reflect negatively on Sponsor.
3. Sweepstakes Period
Entries will be accepted online starting on or about August 13, 2026 at 5:00 PM CT and ending August 13, 2026 at 9:00 PM CT (the “Sweepstakes Period”). All online entries must be received by August 13, 2026 at 9:00 PM CT.
No responsibility is assumed by Sponsor for lost, late, misdirected, or illegible Entries or for any computer, online, telephone or technical malfunctions that may occur. Entries will be declared made by the authorized account holder submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to the e-mail address submitted in connection with the Entry. All Entries become the property of Sponsor and will not be acknowledged or returned to the participant.
4. How to Enter
No purchase necessary to enter or win. To enter, participants must be physically present at the Howler Brothers Longhorn Luau at Hula Hut on August 13, 2026 and submit an entry using the online form provided on the Howler Brothers website (an “Entry” or “Entries”). All fields must be completed. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. You may enter via the online form only once. You may not enter more than once by using multiple e-mail addresses, identities, or devices to circumvent the rules. Sponsor reserves the right, at its sole discretion, to disqualify any individual who does not follow the entry process or these Official Rules.
Entries have no value and an Entry does not entitle a participant to any compensation of any type or kind. If a participant chooses to use a mobile device to submit an Entry, then depending on the carrier, charges may apply.
5. Prize
There will be two winners, each of whom will receive one of the prizes below:
All federal, state and local taxes and any other costs and expenses associated with the acceptance and/or use of Prize not specifically provided for in these Official Rules are solely the winner’s responsibility. The winner is solely responsible for reporting and paying any and all applicable taxes. Prize is non-transferable and may not be redeemed for cash. No substitution except at Sponsor’s discretion. Sponsor will award the Prize without any payment or other compensation by the winner.
6. Odds
The odds of winning depend on the number of eligible Entries received.
7. Winner Selection and Notification
The winners of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsor. Winner selection will be made by Sponsor or its designated representative, whose decision shall be final. Winners will be notified via e-mail to the e-mail address they entered in the Sweepstakes entry within seven days following the end of the Sweepstakes Period. Sponsor may also publicly announce the winners on its social media accounts (including by tagging the winner’s Instagram handle, if provided); however, such public announcement does not constitute official notification and does not create any obligation on the part of the winner to maintain or monitor a social media account. The winner must sign and return an Affidavit of Eligibility, and Liability and Publicity Release, and W-9 upon Sponsor’s request. Noncompliance will result in disqualification and an alternate winner will be selected. Sponsor reserves the right to determine the method of notification and alternative methods, if any. Sponsor shall have no liability for a participant’s failure to receive notices due to participant’s spam, junk e-mail, or other security settings or for participant’s provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within five days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required in the notification, the prize may be forfeited and an alternate winner selected.
8. Sponsor
The Sponsor of the Sweepstakes is Howler Brothers, 1010-A West Lynn St., Austin, TX 78703, United States.
By participating in this Sweepstakes, you agree that it is in no way sponsored, endorsed or administered by, or associated with Meta, Facebook or Instagram (the “Platforms”) and release the Platforms from any and all liability arising from or related to this Sweepstakes. You understand that you are providing your information to the Sponsor and not to any such Platforms.
9. Release
By accepting a prize, any winner grants Sponsor (including anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns) the right to use the winner’s name, image and likeness, which includes, without limitation, voice, signature, photograph, biographical and social media handles (as well as the name, photograph and likeness of their companions) (“Likeness”) for advertising, publicity, promotional and other purposes in any and all media, now or hereafter devised, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law.
Except where otherwise prohibited by law, participant grants Sponsor permission to use his/her Likeness for advertising and promotional purposes without compensation.
Participant grants Sponsor the non-exclusive, irrevocable, royalty-free, fully-paid, unencumbered, transferable, sub-licensable, perpetual, and universe-wide right, but not the obligation, to reproduce, prepare derivative works based upon, distribute, transmit, publicly perform, publicly display, compile, archive, syndicate and otherwise use and exploit the Entry and any content submitted to Sponsor (including without limitation copyrights), as well as any and all derivatives thereof, in any and all languages, and in any and all manners, mediums, and forms now known or hereinafter devised.
Participant represents and warrants to Sponsor that s/he has full legal right, power, and authority to grant the foregoing licenses, and, if applicable, has secured all necessary rights from any subjects depicted in, and/or individuals who contributed to, the Entry and content submitted in order to grant such license.
10. Limitation of Liability
By entering you agree to release and hold harmless Howler Brothers and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; and (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries.
PARTICIPANT FULLY RELEASES THE SPONSOR AND THE PLATFORMS FROM ANY AND ALL LIABILITY, AND WAIVES ALL SUCH LIABILITY, CAUSED BY OR RESULTING FROM THE USE OR POSSESSION OF ANY PRIZE AWARDED OR CAUSED BY OR RESULTING FROM PARTICIPATION IN THE SWEEPSTAKES OR ANY RELATED PROMOTION. PARTICIPANT UNDERSTANDS AND AGREES THAT IN NO EVENT WILL THE SPONSOR OR THE PLATFORMS BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, STATUTORY OR PUNITIVE DAMAGES ASSOCIATED WITH PARTICIPATION IN THE SWEEPSTAKES OR USE OF ANY PRIZE. PARTICIPANT FURTHER UNDERSTANDS AND AGREES THAT ANY PRIZE AWARDED IS RECEIVED “AS IS,” WITHOUT ANY WARRANTY OR REPRESENTATION OF ANY KIND FROM SPONSOR, AND THAT ALL SUCH WARRANTIES, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
11. Disputes and Governing Law; Jury and Class Action Waiver
THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF TEXAS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, the parties agree that all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action. EACH PARTY AGREES THAT VENUE FOR ANY LEGAL ACTION ARISING OUT OF OR RELATING TO THE SWEEPSTAKES SHALL BE IN TRAVIS COUNTY, TEXAS, AND SHALL NOT BE SUBJECT TO TRANSFER TO ANOTHER VENUE OR LOCALE, and each party irrevocably submits to the exclusive jurisdiction of such courts in any such legal proceeding. The parties irrevocably and unconditionally waive any objection to venue of any suit, action, or proceeding in such courts and irrevocably waive and agree not to plead or claim in any such court that any such suit, action, or proceeding brought in any such court has been brought in an inconvenient forum. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and you further waive all rights to have damages multiplied or increased.
EACH PARTY DOES HEREBY WAIVE HIS/HER/ITS RIGHT TO A TRIAL BY JURY, TO PARTICIPATE AS THE MEMBER OF A CLASS IN ANY PURPORTED CLASS ACTION OR OTHER PROCEEDING, OR TO NAME UNNAMED MEMBERS IN ANY PURPORTED CLASS ACTION OR OTHER PROCEEDINGS.

YOU UNDERSTAND AND AGREE THAT THE INFORMATION YOU PROVIDE WILL BE USED FOR MARKETING PURPOSES BY THE SPONSOR. IN ADDITION TO ANY USES OF YOUR INFORMATION MENTIONED IN THESE OFFICIAL RULES, THE PRIVACY POLICY REFERENCED IN THE PARAGRAPH ABOVE WILL GOVERN USE OF YOUR INFORMATION. YOU SHOULD REVIEW THAT PRIVACY POLICY.
13. Winners List
Official Rules and the name of the winners may be obtained by sending a self-addressed, stamped envelope to: Howler Brothers, Attn: Marketing; 1010-A West Lynn St., Austin, TX 78703, United States. Indicate “Howler Brothers Los Longhorns de Tejas Surfboard Giveaway Official Rules Request” or “Howler Brothers Los Longhorns de Tejas Surfboard Giveaway Winner List” on the outside of the envelope as applicable. Limit one request per envelope. The request must include the name of the Sweepstakes. Participants may also submit questions or request the Official Rules by sending an email detailing their request to marketing@howlerbros.com. 14. General Terms
The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with all federal and state laws and regulations. VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

At Sponsor’s sole discretion and option, the dates for the Sweepstakes may be extended by no more than 30 days. Sponsor is not responsible for: (i) any lost, late, incomplete, illegible, inaccurate, delayed, stolen, misdirected, undelivered or garbled entry; (ii) lost, interrupted or unavailable network, server, ISP, website, or other connection; or (iii) any other technical failure or jumbled, scrambled, delayed, or misdirected transmission or computer hardware error or malfunction in connection with the Sweepstakes.
Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes or disqualify a participant for any reason, including, but not limited to, any corruption or impairment of the administration, security, fairness or proper play of the Sweepstakes (in Sponsor’s sole discretion), and, if terminated, to randomly select winners from the eligible entries received or award the prizes to a charity of Sponsor’s choosing. All decisions of Sponsor in any matter relating to this Sweepstakes shall be binding and final.
By entering the Sweepstakes, you acknowledge that Sponsor may use the e-mail address you provide to send you marketing communications, if you have opted in to receive such communications. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter.
By participating in the Sweepstakes, you agree to be fully and unconditionally bound by these Official Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding as they relate to the Sweepstakes.
If any provision of these Official Rules is held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
